- This Fly Kingfisher - Fisical Force Contest ("Promotion") is open to all Indian Citizens above the age of 18 years who travel on flights operated by Fly Kingfisher (KFA) between June 10, 2008 and July 10, 2008 both days inclusive ("the Promotion Period").
- Neither the employees of Times Internet Limited (TIL) or Kingfisher Airlines Limited nor the families or relatives of employees of TIL or Fly Kingfisher are eligible to participate in the Promotion.
- Guests traveling on Fly Kingfisher during the Promotion Period must SMS his / her PNR number for the said flight along with the Guest's name and flight number of the flight undertaken as appearing in the Boarding Pass, immediately after completion of travel of the said flight and in any case not later than 24 hours after the day of travel, to 58888.
- By doing the above, the Guest confirms his / her participation in the Promotion and confirms his / her acceptance to the Terms and Conditions herein.
- Upon receipt of the SMS, the Guest will receive a question by SMS to be answered in the manner set out in the SMS.
- All Guests who answer the question correctly (and provide the details mentioned in (3) above accurately) will be considered Qualifying Guests and the relevant PNRs will be Qualifying PNRs. All Qualifying PNRs will form part of this Promotion that consists of the draw. The Qualifying Guests stand a chance to win a prize.
- During the Promotion Period, Five (5) winners will be declared from the Qualifying PNRs, on the basis of a draw. Each of these winners will win a paid trip for the Grand Prix at Singapore scheduled for September 2008 (Grand Prix Package) ...
- The Grand Prix package would include:
- To and Fro airfare in economy class to Singapore
- 3 nights/4 days stay at a premium hotel in Singapore
- Airport Pick up and Drop
- Breakfast at the hotel
- 1 weekend Grandstand pass to the Singapore Grand Prix
- Opportunity to meet and interact with Giancarlo Fisichella and/or other Force India
- Apart from the Grand Prix Package prize, any Guest who flies Fly Kingfisher during the Promotion Period is eligible to be a part of the Hot Seat of the Day contest.
On each flight one seat would be selected as the Hot Seat of the Day through a random selection process by the cabin crew, in that flight
- The winner of the Hot Seat of the Day would receive official Fly Kingfisher or Force India Merchandise, that will be given to the winning Guest on board the flight.
- There is no entry fee for participating in the Promotion, except for the SMS charges of Rs.3 per SMS or as applicable by the network provider.
- This Promotion is not valid on any flights that may be cancelled during the Promotion Period or flights that may be delayed and commence after the midnight of 10th July, 2008.
- Declaration of the names of the winners by Fly Kingfisher will be final and absolute and binding on all participants/ Guests and shall not be open to question or challenge.
- Only valid utilized PNRs on flights operated by Fly Kingfishershall be eligible for this Promotion. Guests furnishing incorrect and/or incomplete information in their SMS message may not qualify for the draw, not withstanding that the said Guest has answered the question correctly and the decision on the same shall be at the sole discretion of Fly Kingfisher.
- One participation entry entitles the participating guest to win only one prize.
- Mere participation in the Promotion does not entitle the Guest to win a Prize.
- Upon Fly Kingfisher deciding the winners of the Grand Prix Package prize, Fly Kingfisher shall send the Winner a letter informing that he / she has won a Grand Prix Package prize.
- All applicable Government taxes, if any, on the prizes won are to be borne by the Winner and the winning Guest will be responsible for compliance with applicable laws and regulations and Fly Kingfisher and TIL will have no liability in respect of the same.
- On receipt of the letter by the Winner, the Winner in order to be entitled to claim and be eligible to receive the Prize will have to produce the following:
- The flown Boarding Pass that has the winning PNR mentioned.
- The Winner Letter from Fly Kingfisher.
- Copy of Identity proof / age proof / address proof evidenced by authentic Government documents such as passport, driving license etc.
- Copy of the PAN card. (Why is this required?)
Originals of the documents furnished above should be available to Fly Kingfisher for perusal at any time before the prize is awarded.
- All the above documents have to be sent to TIL by Registered Post or by Hand-delivery as per instructions specified in the letter from Fly Kingfisher to the winner of a prize..
- If the Winner fails to produce any of the above documents within 15 days from the demand thereof, the Winner shall not be eligible to claim the prize and the prize shall stand forfeited and may be granted to any alternative that Fly Kingfisher may declare at its sole discretion from the Qualifying PNRs, and Fly Kingfisher/ TIL shall not be liable in any manner whatsoever in this regard.
- TIL and/or Fly Kingfisher reserve the rights at any time to change, modify, withdraw, extend or terminate the Promotion at their sole discretion without any prior notice and without any liability or obligation in this regard.
- TIL/Fly Kingfisher will in no event be liable for any damages - indirect, special, incidental, or consequential arising out of the use of any information contained in the micro-site.
- In addition to these terms & conditions, the Guest shall also be governed by any other conditions as may be imposed from time to time including by sponsor(s), if any.
- Fly Kingfisher and TIL shall not be liable for any loss or damage whatsoever that may be suffered or any personal injury that may be suffered by any person as a result of participating in the Promotion or arising out of winning the Promotion . Fly Kingfisher and TIL do not warrant or make any representation or assurance on the quality of the prizes and shall in no event be liable in this regard. Fly Kingfisher and TIL shall endeavor to provide the Winner with the exact prize announced. In the event of non-availability or inability of Fly Kingfisher to give the exact prize announced for any reason whatsoever, Fly Kingfisher shall have the right to offer an alternate prize of approximately equivalent value and the Guest shall unconditionally accept the same and shall not hold Fly Kingfisher liable on any account.
- Winner(s) agree to collect prize(s) in the manner and as per the procedure specified by Fly Kingfisher/ TIL.
- All communication received by/ available to Fly Kingfisher / TIL in connection with this Promotion shall be deemed to be non-confidential. Fly Kingfisher / TIL is free to reproduce, distribute, use, share and/or publicly display such communication including feedback and/or contest entries without limitation or liability of any kind upon Fly Kingfisher / TIL.
- By participating in the Promotion by the Guest, the Guest irrevocably consents to use by Fly Kingfisher and TIL and their affiliates, the information supplied by the Winner including but not limited to Guest's name, Likeness, voice, comments, ideas, concepts, know-how or techniques contained in any feedback or Promotion entry, in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the Winner.
- All decision of Fly Kingfisher and TIL under this Promotion shall be final and binding on all Participants.
- This Promotion shall be governed by and construed in accordance with the laws of India and it is irrevocably and unconditionally agreed that the Courts of Mumbai shall have exclusive jurisdiction to entertain any disputes arising from or in relation to or concerning the Promotion.
